Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, OJ EU L 119 of 4.5.2016, hereinafter referred to as “GDPR”), we hereby inform you that:
- The Controller of your personal data is Edbak Sp. z o.o., Piotrowice 186, 23-107 Strzyżewice (Edbak).
- Personal data is processed with appropriate security measures in place, in compliance with the requirements set out by applicable law.
- Personal data will be processed for the following purposes:
- for the conclusion and performance of contracts, including but not limited to the sale of products, provision of installation, maintenance, post-production processing services, etc. – pursuant to Article 6(1)(b) of the GDPR,
- for the fulfilment of legal obligations incumbent on the Controller in connection with the performance of contracts, in particular obligations related to accounting and tax settlements – pursuant to Article 6(1)(c) of the GDPR,
- for the establishment, exercise and defence of claims between the contractor and the Controller – pursuant to Article 6(1)(f) of the GDPR;
in the case of monitoring and the processing of image data – for the purpose of pursuing the Controller’s legitimate interest in the protection of property and ensuring safety in the monitored area – pursuant to Article 6(1)(f) of the GDPR, - for the performance of warranty or complaint services – pursuant to Article 6(1)(b) of the GDPR,
- for the marketing of own products and services through the electronic delivery of information about promotions and new products – based on consent, i.e., pursuant to Article 6(1)(a) of the GDPR,
- for statistical purposes within the scope of the legitimate interests of the personal data controller – pursuant to Article 6(1)(f) of the GDPR.
- for other purposes, as specifically defined in separate information clauses – based on consent, i.e., pursuant to Article 6(1)(a) of the GDPR.
- The provision of personal data is voluntary, but it may be necessary for the fulfilment of certain processing purposes. Failure to provide personal data:
- in the case of data processing for the purpose referred to in point 3(a) above – will prevent the conclusion and performance of the contract,
- in the case of data processing for the purpose referred to in point 3(d) above – will prevent the performance of warranty or complaint services,
- in the case of data processing for the purpose referred to in point 3(e) above – will not have any negative consequences, but will prevent the transmission of promotional and new product information to you via electronic means,
- in the case of data processing for the purposes referred to in points 3(b), 3(c), and 3(f) above – will prevent the fulfilment of the specified purposes.
- Personal data will be stored only for the period necessary to properly achieve the purposes mentioned above, after which the data will be retained for the period of limitation of claims and criminal offences or for the period required by applicable legal regulations, e.g., tax regulations. The Controller may retain personal data for a longer period only if required to do so by generally applicable legal provisions or if there is another legal basis for data processing as defined in Article 6(1) of the GDPR.
- Recipients of personal data may only include entities authorized to receive such data under applicable legal provisions. Additionally, personal data may be disclosed or entrusted (in accordance with Article 28 of the GDPR) to other entities under a data processing agreement (e.g., entities providing postal, courier, banking, consulting, financial, accounting, tax, audit, legal services, as well as entities providing IT services such as hosting or maintenance of IT systems and software), including suppliers and service providers, if their cooperation with Edbak is justified by the data processing purposes described above.
- You have the right to access your personal data, rectify it, delete it, restrict its processing, transfer the data, and object to its processing. If your personal data is processed based on consent, you also have the right to withdraw your consent at any time, without affecting the lawfulness of the processing carried out on the basis of the consent before its withdrawal.
- If you believe that your personal data has been processed in violation of data protection regulations, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or the place of the alleged infringement.
- Personal data will not be transferred outside the territory of the European Union or the European Economic Area.
