Since your use of services from Edbak Sp. z o.o. may involve the processing of your Personal Data (henceforth “Personal Data”, “Data”), we would like to ask you to read the information below.

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such Personal Data, and repealing Directive 95/46/EC (General Data Protection Regulation, OJ EU L 2016.119.1, or “GDPR”) you are advised of the following:

    1. Your Personal Data Controller is Edbak Sp. z o.o., Piotrowice 186, 23-107 Strzyżewice (“Edbak”).
    2. Your Personal Data is processed with proper security precautions applied in compliance with specific regulatory requirements.
    3. Your Personal Data will be processed for the following purposes:
      1. Conclusion and fulfilment of contracts e.g. for sales of products, installation services, technical servicing, as-built processing, etc., with the Personal Data processed pursuant to GDPR Article 6(1)(b);
      2. Discharge of the Personal Data Controller’s legal obligations from the fulfilment of contracts, particularly the obligations in accounting and tax declaration, with the Personal Data processed pursuant to GDPR Article 6(1)(c);
      3. Identification of, pursuit of, and indemnity from claims between the Personal Data Controller and the customer, with the Personal Data processed pursuant to GDPR Article 6(1)(f), and for the use of monitoring and processing of Personal Data in the form of image or likeness – the realisation of the lawful interests of the Personal Data Controller in protection of property and physical security on monitored premises, with the Personal Data processed pursuant to GDPR Article 6(1)(f);
      4. Fulfilment of warranty and warranty claim services, with the Personal Data processed pursuant to GDPR Article 6(1)(b);
      5. Marketing of proprietary products and services by transmission of electronic communications concerning promotional campaigns and news with your consent and with the Personal Data processed pursuant to GDPR Article 6(1)(a);
      6. Statistical purposes, to extent of lawful and reasonable interests of the Personal Data Controller, with the Personal Data processed pursuant to GDPR Article 6(1)(f);
      7. Other purposes detailed in separate information clauses, with your consent and with the Personal Data processed pursuant to GDPR Article 6(1)(a).
    4. Your submission of your Personal Data is voluntary, but the Personal Data could be necessary to meet certain purposes of its processing, and your denial to submit the Personal Data:
      1. For the Personal Data Processing for purposes identified in item 3(a) – will prevent conclusion and fulfilment of a contract;
      2. for the Personal Data Processing for purposes identified in item 3(d) – will prevent fulfilment of warranty or warranty claim services;
      3. for the Personal Data Processing for purposes identified in item 3(e) – will have no negative consequences, while transmission of electronic communications concerning promotional campaigns and news to you;
      4. for the Personal Data Processing for purposes identified in items 3(b), (c), and (f) – will prevent meeting those purposes.
    5. Your Personal Data will only be stored for the period required to properly meet the foregoing purposes, after which the Personal Data will continue to be stored for the period of limitation of claims and criminal acts or for the period made mandatory by law, including tax laws. The Personal Data Controller can store your Personal Data for a longer period if required to do so by generally applicable laws or on another basis of personal data processing established in GDPR Article 6(1).
    6. The Personal Data recipients may only include entities lawfully authorised to receive the Personal Data. Moreover, your Personal Data can be disclosed or their processing outsourced (pursuant to GDPR Article 28) to other entities pursuant to a separate agreement (and where these entities may include postal, courier, banking, consulting, financial, accounting, tax, auditing, or legal service providers, and providers of IT hosting services or IT system and software servicing), including suppliers and technical services if the cooperation of these entities and Edbak is reasonably based on the foregoing Personal Data processing purposes. If your Personal Data is processed for marketing of proprietary products and services by transmission of electronic communications concerning promotional campaigns and news, the Personal Data recipients may include advertising agencies and marketing service providers (including their specific employees and cooperatives) to the extent these entities take part in the marketing activities of Edbak.
    7. You have the right to: access, correct, expunge, restrict processing of, transfer, and object to further processing of your Personal Data, and to revoke the consent you have given for processing of your Personal Data at any time without any effect on the lawfulness of all prior processing of your Personal Data.
    8. If you believe Personal Data protection laws have been breached, you have the right to file a complaint with the relevant Personal Data processing supervisory authority, in particular in the EU member state of your regular residence or of your work place, or the location of the alleged breach.
    9. Your Personal Data will not be transmitted outside of the European Union or the European Economic Area.
